Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the APInguin platform, website and related services (the “Service”), operated by APInguin (“APInguin”, “we”, “us”). By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the organization you represent. If you do not agree, do not use the Service.

APInguin scans publicly available marketing content - such as videos, social posts, web pages and advertisements on your own channels and those of creators you work with - and flags potential compliance issues (for example missing sponsorship disclosures, unsupported claims or unlicensed assets), with citations to the relevant rules.

The Service does not provide legal advice. Scan results, scores, findings and reports are automated assessments produced in part by AI models. They can be incomplete or incorrect and are provided to support - not replace - review by qualified professionals. You remain solely responsible for your content and your compliance with applicable law.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You agree not to:

• use the Service to violate any law or the rights of others;
• scan content you have no legitimate business reason to assess, or use the Service to harass, surveil or defame any person;
• probe, disrupt or circumvent the Service’s security, rate limits or usage caps, or resell access without our written consent;
• reverse engineer the Service or use it to build a competing product.

Paid plans are billed through our payment processor (Stripe) on the schedule shown at checkout. Fees are non-refundable except where required by law. Usage is subject to the quotas of your plan; we may throttle or pause scanning that exceeds them. You can cancel at any time, effective at the end of the current billing period. We may change prices with at least 30 days’ notice.

You retain all rights to the data you submit and to the reports generated for your account. You grant us a limited license to process that data solely to provide and improve the Service. Our handling of personal data is described in our Privacy Policy. Scanned content is sourced from publicly available material on the platforms you connect or reference.

The Service, including its software, design, models, rubrics and branding, is owned by APInguin and protected by intellectual property laws. These Terms grant you no rights in the Service other than the limited right to use it in accordance with these Terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT SCAN RESULTS WILL IDENTIFY EVERY COMPLIANCE ISSUE OR THAT FLAGGED ITEMS CONSTITUTE ACTUAL VIOLATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APINGUIN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, abuse of the Service or non-payment. Sections 5 through 10 survive termination. Upon termination we will make your data available for export for a reasonable period, after which it may be deleted.

We may update these Terms from time to time; material changes will be notified via the Service or email, and continued use after the effective date constitutes acceptance. If any provision is found unenforceable, the remainder stays in effect. These Terms are the entire agreement between you and APInguin regarding the Service, unless a separately signed agreement applies.
